7. Return, Refund, and Replacement of Goods 

7.1 Subject to all applicable and relevant laws, the Buyer shall not repudiate this Contract once the property of the Goods purchased has passed to the Buyer and any breach of the warrant will not be a ground for rejecting the goods and treating the contract as repudiated unless otherwise agreed by the Parties in writing and subject to the other terms in this Contract.  

7.2   Goods sold on the Platform by MyCPMall are covered under the MyCPMall 5 Days Easy Returns depending on the Goods sold (“Return Policy”). The buyer may initiate the returns process by communicating with MyCPMall through the Platform. As for the Goods sold by the Third Party Vendor, it is subject to the return, refund, and replacement policies of each Third Party Vendor. 
7.3  Buyer may, may apply to return the purchased Goods to MyCPMall or Seller in exchange for a replacement or a refund stating the details of the purchase and attaching the relevant receipts of purchase and/or images where relevant via the After Sales Service function Buyer shall ensure that the purchased Goods is returned to MyCPMall or Seller within 5 to 10  calendar days from the delivery date, depending on the applicable Return Policy. For the avoidance of doubt, the countdown starts from the date the Buyer received the purchased Goods to the post stamp date on the return parcel. In case of damaged Goods, please contact MyCPMall or Seller within five (5) days of receiving the delivery to expedite the claim process. 
7.4  Buyer may only apply for return of the purchased goods in the following circumstances : 
i)  the Goods delivered to Buyer is defective and/or damaged on delivery; 
ii)  the Goods, in particular, fashion items, which does not fit (not applicable for fashion items from overseas Sellers); 
iii)  the Goods delivered to Buyer is materially different from the description provided by Seller in the listing of the Goods; 
iv)  the Goods delivered to Buyer does not match the agreed specification (e.g. wrong size, color, etc.) stipulated in the order; 
v)  Buyer has a change of mind with regard to the Goods; and 
Provided always that the Buyer shall bear the costs, charges, and/or fees incurred herein and that the Goods returned shall be in good condition, original packaging, unused attached with the original receipt and/or warranty (where relevant), and as such other circumstances which may be prescribed by MyCPMall on the Platform. 
7.5  Notwithstanding Clause 7.4 above, return or cancellations of any perishable goods are not allowed. To ensure that Buyer is satisfied with the product Buyer received, Buyer should inspect the contents as soon as the order arrives. 
7.6  The application for return of Purchased Goods may also be subject to additional terms and conditions prescribed by MyCPMall on the Platform. Please refer to the “After Sales Function” and/or contact our customer service officers for further details. 
7.7.1  In regards to any questions and/or complaints the Buyer may access the respective functions on the Platform or (i) you may either contact the Seller directly via the Platform or (ii) contact MyCPMall using the “Contact Us” page on the Platform, as applicable. 
7.7.2  In the event that Buyer is unable to resolve any dispute with Seller directly through amicable negotiations, MyCPMall reserves the right to suggest and implement an appropriate resolution at its sole discretion.
